These Terms & Conditions ("Terms") govern access to and use of the website scaleup.lol ("ScaleUp", "the Site", "we", "us"), operated by Scaleup, based in Amritsar, Punjab, India. By accessing or using the Site, or by claiming a rank on the leaderboard, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to make a payment or claim a rank on ScaleUp.

2. What ScaleUp provides

ScaleUp is a paid, ranked leaderboard. Paying the listed price for a position places your listing at that rank until another user pays a higher price for the same position, as described in full on the Rules page, which forms part of these Terms.

3. Payments

All prices are listed in Indian Rupees (₹) and inclusive/exclusive of applicable taxes as shown at checkout. Payments are processed by a third-party, RBI-regulated payment gateway. ScaleUp does not collect or store your card, UPI, or net-banking credentials — that data is handled entirely by the payment gateway in accordance with its own security standards.

4. Your listing content

You are solely responsible for the accuracy and legality of the name, description, and link you submit with a claim. You confirm that you have the right to advertise the brand, product, or service you list, and that your listing does not infringe any third party's trademark, copyright, or other rights.

5. Prohibited use

You agree not to use the Site to list or link to anything unlawful under Indian law, including but not limited to content that is obscene, defamatory, infringing, or that facilitates fraud. See Rules for specific examples. We reserve the right to remove any listing and suspend any user at our discretion for a breach of these Terms.

6. No guarantee of outcome

ScaleUp sells visibility in the form of a ranked position. We make no representation or warranty about the number of visitors, clicks, or business outcomes a listing will generate. Traffic to the Site varies and is outside our control.

7. Limitation of liability

To the maximum extent permitted under Indian law, ScaleUp and its operator shall not be liable for any indirect, incidental, or consequential loss arising from use of the Site, including loss of business, revenue, or data. Our total liability for any claim arising from these Terms is limited to the amount you paid to ScaleUp in the three months preceding the claim.

8. Intellectual property

The ScaleUp name, logo, and site design are the property of the Site operator. Listing a brand on the board does not transfer any rights in that brand to ScaleUp, and nothing on the Site transfers any ScaleUp intellectual property to you.

9. Grievance redressal

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, any complaints or concerns regarding content on the Site may be addressed to our Grievance Officer:

We will acknowledge complaints within 24 hours and aim to resolve them within 15 days, as required under applicable rules.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the Site after a change constitutes acceptance of the revised Terms. Material changes will be reflected by updating the date at the top of this page.

11. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or use of the Site shall be subject to the exclusive jurisdiction of the courts at Amritsar, Punjab.
